Terms of Service

1. Acceptance of Terms
By accessing or using Crit-Fumble ("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines, all of which are incorporated here by reference. If you do not agree to these Terms, you may not access or use the Service.
This is an 18+ platform. By using the Service you confirm you are at least 18 years old.
2. Description of Service
Crit-Fumble is a virtual tabletop platform that provides:
- Campaign management and world-building tools
- Character sheet creation and tracking
- Discord Activities for voice channel integration
- Multiverse and universe management
- Integration with RPG systems and tools
3. Account Registration
You must be 18 years of age or older to use this Service. By registering, you confirm that you meet this requirement. Accounts found to belong to minors will be permanently closed and all data deleted.
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We do not require your real name.Your display name is a handle or username — use whatever you're comfortable sharing publicly. Real identity information is never required to use the platform.
4. User Content and Ownership
4.1 Your Content Is Yours
You retain full ownership of all content you create on Crit-Fumble, including campaigns, characters, worlds, lore, game systems, compendium entries, and any other creative or data works ("User Content"). Crit-Fumble claims no ownership over your User Content and does not acquire any rights in it beyond those strictly necessary to operate the platform.
4.2 License Grant
By posting User Content, you grant Crit-Fumble a worldwide, non-exclusive, royalty-free license solely to:
- Store, display, and transmit your User Content to provide the service
- Enable sharing features you choose to use
- Create backups and ensure service functionality
This license does not grant Crit-Fumble the right to sell, sublicense, or commercially exploit your User Content in any way beyond providing the platform to you.
4.3 Your Licensing Freedom
You are free to license, share, publish, or distribute your User Content under any terms you choose — including open licenses, commercial licenses, or any other arrangement — without restriction or permission from Crit-Fumble. Your content is yours to do with as you see fit.
4.4 Digital Product Revenue
Any revenue you generate from digital products sold or distributed through the Crit-Fumble platform belongs entirely to you. Crit-Fumble does not take a cut of digital product sales. Platform fees (compute, hosting, subscriptions) are separate from and do not apply to revenue you earn from your own content.
4.5 Physical Products
Physical production of your content (printed books, miniatures, dice, and other physical goods) is outside the scope of this agreement and is subject to separate negotiation. Crit-Fumble may offer prototyping assistance (resin printing, filament printing, book publishing guidance) as a service on mutually agreed terms. Any such arrangement does not affect your ownership of the underlying content.
4.6 Absolute Content Prohibitions
The following content is prohibited under all circumstances, regardless of claimed fictional framing, session consent, or any other justification:
- Child sexual abuse material (CSAM)— any content that sexually depicts or exploits minors (persons under 18), including fictional, illustrated, or AI-generated depictions. We are required by law to report such content to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, and will do so immediately.
- Non-consensual intimate imagery — sharing or uploading sexual images or depictions of a real person without their explicit consent
- Hate speech — content targeting race, ethnicity, gender identity, sexual orientation, religion, disability, or nationality
- Doxxing — disclosing another person's private or identifying real-world information without their consent
- Pirated material — uploading, sharing, or linking to copyrighted game resources, ROMs, or other content you do not have the right to distribute
- Malware, viruses, or malicious scripts
- Threats, targeted harassment, or content designed to intimidate a specific individual
- Any other content that is illegal in the jurisdiction where Crit-Fumble operates
4.7 Consent-Gated Content
Mature content above a PG-13 baseline — including strong language, graphic violence, or sexual content between adult characters — may only occur within a session where every participant has explicitly agreed via a Session Zero discussion before the campaign begins. The GM is responsible for facilitating this and may not run mature content without documented consent from all players.
The Session Zero consent framework governs legal adult content only. It does not and cannot unlock any content listed in §4.6 above. See our Community Guidelines for guidance on running a Session Zero.
5. File Uploads and Storage
The platform accepts the following types of user-uploaded files:
- Images (avatars, character portraits, campaign banners) — JPEG, PNG, WebP, GIF; automatically converted to WebP for storage
- Documents (campaign notes, handouts) — stored privately; accessible only to you via time-limited links
- ROM files (for digital game integration) — stored privately; you must own or have a legal right to use any ROM you upload
All uploaded content is subject to the prohibitions in §4.6. We reserve the right to remove any uploaded file that violates these Terms. Storage quotas apply per account tier; see your account settings for your current usage.
6. Voice Sessions and Streaming
Voice and video during VTT sessions are handled in real-time and are not recorded or stored by Crit-Fumble. Audio and video pass through LiveKit servers for routing and are discarded after the session ends.
If a GM chooses to stream a session live (via the optional Twitch integration), the stream is routed from LiveKit to Twitch. Whether that stream is saved as a VOD is controlled by the broadcaster's Twitch account settings — not by Crit-Fumble.
- All community conduct rules apply to voice sessions
- When using Discord Activities, you must also comply with Discord's Terms of Service
- We are not responsible for the availability of Discord, LiveKit, or Twitch services
7. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated scripts or bots to access the Service without authorization
- Impersonate any person or entity
- Collect, harvest, or share another user's personal or identifying information without their consent
- Direct hate speech, harassment, or targeted abuse at any person
- Share or promote pirated game resources or copyrighted material you do not have the right to distribute
- Reverse engineer or attempt to extract source code from the Service
8. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Crit-Fumble and are protected by international copyright, trademark, and other intellectual property laws.
Third-party RPG systems, game rules, and trademarks remain the property of their respective owners.
9. Payment and Subscriptions
Certain features may require payment. By subscribing to a paid plan:
- You agree to pay all applicable fees
- Subscriptions automatically renew unless cancelled
- Refunds are provided at our discretion
- We may change pricing with 30 days' notice
10. Enforcement and Termination
Violations of these Terms or the Community Guidelines are handled in proportion to their severity:
- Warning — for minor or first-time violations
- Removal from session or campaign — at the GM's or an admin's discretion
- Temporary suspension — for repeated violations or more serious conduct
- Permanent ban — for egregious violations including hate speech, doxxing, harassment, piracy, or any conduct involving minors
We may also suspend or terminate accounts if required by law or a valid legal request. When an account is terminated for conduct violations, we may retain a minimal record of the violation and ban for platform safety purposes.
You may terminate your own account at any time through your Account → Privacy & Data settings.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRIT-FUMBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
13. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
14. Community Standards
Use of the Service is subject to our Community Guidelines, which are incorporated into these Terms by reference. Key obligations include:
- Treating all participants with respect; no hate speech in any form
- Honouring preferred names and pronouns
- Running a Session Zero before a campaign begins to establish consent-based content boundaries
- Keeping all mature content within the boundaries explicitly agreed to by every participant
- Never sharing another person's real-world identifying information
- Not sharing or promoting pirated game materials
Violations of the Community Guidelines are violations of these Terms and are subject to the enforcement process described in Section 9.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crit-Fumble operates, without regard to its conflict of law provisions.
